The following describes the Puget Sound Regional Council's Complaint Procedure under the Americans with Disabilities Act.
This Complaint Procedure is established to meet the requirements of the Americans with Disabilities Act of 1990 (“ADA”). It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs or benefits by the Puget Sound Regional Council. The agency’s Personnel Policy governs employment-related complaints of disability discrimination.
The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request. In addition, complainants may use PSRC’s complaint form.
The complaint should be submitted by the grievant and/or their designee as soon as possible but no later than 180 calendar days after the alleged violation to:

Once a discrimination complaint is received by PSRC, PSRC’s ADA Coordinator will review the complaint and the complainant will receive an acknowledgment letter informing them whether the complaint will be investigated by PSRC.
PSRC’s goal is to resolve these complaints within 30 calendar days of receipt. After the ADA Coordinator reviews the complaint, one of two letters will be issued to the complainant: a closure letter or a letter of finding (LOF). A closure letter summarizes the allegations and states that there was no disability violation and that the case is closed. An LOF summarizes the allegations and provides an explanation of the corrective action taken. If the complainant wishes to appeal the decision, they have 30 calendar days from the date of the letter to do so.

PSRC’s Executive Director or designee shall promptly consider the appeal. Consideration of the appeal will be based upon the written appeal and accompanying documentation. At the discretion of the Executive Director, the appeal process may include a meeting with the appealing party.
PSRC’s Executive Director or designee will, within a reasonable time, but not to exceed 60 calendar days from receipt of the appeal by PSRC, issue a written decision to the appealing party. The decision shall include an explanation of the reasons for the decision and any facts that were considered in rendering the decision. The decision by the Executive Director or designee shall constitute the final administrative determination by PSRC.
PSRC abides by Washington State records retention guidelines promulgated by the State’s Secretary of State. Pursuant to those guidelines, PSRC retains complaint records for six (6) years after resolution, completion, or closure of the complaint.
